Public agreement on providing the Customer with the opportunity to use the function of auto-debit for the Service through the PSP Platon payment gateway

1. Terminology

1.1. Unless otherwise specified in this Agreement, the following capitalized words in this Agreement are definitions of this Agreement and have the following meanings in the singular:

1.1.1. Website - a website on the Internet by a domain name https://hostpro.ua/ua, in its entirety or any part of it;

1.1.2. Customer means a person who receives the Service;

1.1.3. Contractor means a person who provides the Service;

1.1.4. Price - the price of the Service set by the Contractor;

1.1.4. Payment gateway Platon - Payment Service Provider Platon (LLC "Payments Online"), which processes payments.

1.2. Unless otherwise specified in this Agreement, when using the plural definition of this Agreement in this Agreement, its meaning is identical to its meaning in the singular, but taking into account the plural number.

2. Subject of the Agreement

2.1.  The public agreement on providing the Customer with the opportunity to use the function of auto-debit for the Service through the PSP Platon payment gateway (hereinafter referred to as the Agreement) between the Customer and the Contractor is concluded from the moment the Customer pays for the Services, as provided for in Part 2 of Article 640 and Part 2 of Article 642 of the Civil Code of Ukraine.

2.2.  The Agreement shall also be deemed to be concluded in accordance with Article 642 of the Civil Code of Ukraine and shall enter into force upon the Customer's selection of the type of Service and prepayment of the Price, which means full and unconditional acceptance by the Customer of all terms and conditions of the Agreement, without any exceptions and/or limitations.

2.3.  When paying the Price, the Customer is additionally informed about the terms of the Agreement, as well as about the activation of the function of auto-debit from the bank card specified by the Customer, which is confirmed by the Customer when clicking the "Pay" button.

2.4.  In accordance with the Agreement, the Customer shall pay the Service Price on an ongoing basis, which is a fixed regular payment and depends on the cost of the Service selected by the Customer and shall be received by the Contractor's account in advance, no later than 00:00 hours of each billing period, taking into account the acceptance of payments by some banking systems.

2.5.  Payment for the Service may be made without the direct participation of the Customer, but with his/her prior consent on an ongoing basis, by means of automatic debiting of the Price from the Customer's bank account or account in the electronic payment gateway PSP Platon, etc. in accordance with the terms and conditions of the bank and/or the payment gateway PSP Platon, if the Price is available on such account.

2.6.  This clause is the Customer's consent to the contractual debiting of his account by the servicing bank when selecting the "Pay" option when ordering and paying for the Service, using online banking.

2.7.  Automatic debiting of the Price for the Contractor's Service occurs systematically, in accordance with the Price of the Service selected by the Customer.

3. Legislation

3.1. This Agreement shall be governed by the laws and regulations of Ukraine.

3.2. From the moment of conclusion of this Agreement, discussions, arrangements, agreements between the Client and the Contractor, which may have taken place before the conclusion of this Agreement and which relate to the subject matter of this Agreement, shall become null and void.
